DECREE

On the Organization and Operation of the

National Transport Committee

 

  • Pursuant to the Law on the Government of the Lao People’s Democratic Republic No.: 01/95 dated 08 March 1995.
  • Pursuant to the Law on Land Transport No.: 03-97/NA, dated 12 April 1997.
  • Pursuant to the Proposal from the Ministry of Communication, Transport, Post and Construction No.: 074/MCTPC, dated 09 January 2002.

The Prime Minister hereby issued a Decree:

 

Chapter I

General Provisions

Article 1. Objectives

This Decree defines the roles, duties, and the scope of the rights of the National Transport Committee to manage domestic, international, and cross-border transportation to ensure convenience, safety, and the ability to integrate the transportation system of the Lao People’s Democratic Republic with ASEAN transportation system, sub-regional, regional, and international systems, aiming to promote the development and advancement of all types of transportation.

Article 2. Location and Roles of the National Transport Committee

The National Transport Committee (NTC) is a non-stationed governmental organization located at the Ministry of Communication, Transport, Post and Construction, which has the roles to study and comment on works related to all types of transportation and it has a duty to coordinate with all concerned sectors, both domestically and internationally, in implementing such transportation works as the Government i.e the Ministry of Communication, Transport, Post and Construction have approved.

 

Chapter II

Duties and Scope of Rights of the National Transport Committee

Article 3. Duties of the National Transport Committee

Apart from the duties defined in Article 39 of the Law on Land Transportation, the National Transport Committee also has the following duties:

  1. To research and comment on regulations, disciplines, laws, and ASEAN, bilateral and multilateral agreements on transport for the Ministry of Communication, Transport, Post and Construction in order to propose for adoption consideration by the Government;
  2. To disseminate ASEAN, bilateral and multilateral agreements and relevant international treaties on transport;
  3. To translate, compile, and publish agreements and international treaties on transport;
  4. To monitor and evaluate the implementation results of regulations, disciplines, laws, agreements, and international treaties on transport;
  5. To support and promote productivity growth in the transport sector as well as ensuring that modern technical science is applied based on the market economic mechanisms administered by the Government and to allow legitimate competition aiming to boost the efficiency of the transport sector, convenience, safety, and environmental friendliness;
  6. To support and promote the utilization of modern distant communications on transport and domestic, ASEAN, sub-regional, regional and international information systems;
  7. To research the use of documents related to international transport for unified transport system procedures of Laos and integrated with the international transport system;
  8. To coordinate with all relevant sectors, both domestically and internationally, to ensure highly effective implementation of international transport agreements;
  9. To attend domestic and international meetings related to their work and seek financial resources or experts to develop transport sector;
  10. To set an annual budget plan to be used in their work for positive outcomes.

Article 4. Scope of the Rights of the National Transport Committee

The National Transport Committee has the following scope of rights:

  1. To cooperate and coordinate with relevant domestic and international sectors on their roles and duties;
  2. To research and comment on disciplines, decisions, laws, and ASEAN, bilateral and multilateral agreements and documents related to all types of transportation for the Ministry of Communication, Transport, Post and Construction;
  3. To exchange and collect information on domestic and international implementation and services on transport for researching and requesting enhancement of the effectiveness;
  4. To disseminate and publicize ASEAN, bilateral and multilateral agreements and international treaties, to monitor and support the implementation of such agreements for positive outcomes;
  5. To submit a list of approved transport service operators and vehicles used in cross-border transport services to the Ministry of Communication, Transport, Post and Construction;
  6. To assign a representative as a member of the international joint committee to implement transport agreements;
  7. To utilize staff, budget, vehicles, and equipment provided by the Government; and
  8. To have other rights as assigned by the Ministry of Communication, Transport, Post and Construction.

 

 

Chapter III

Organizational Structure

Article 5. Organizational and Personnel Structure of the National Transport Committee

5.1. Personnel Structure of the National Transport Committee consists of:

1.   Minister/Deputy Minister of Communication, Transport, Post and Construction as President;

2. Deputy Minister of Commerce as Vice President;

3. Permanent Secretary of the Ministry of Communication, Transport, Post and Construction as Vice President;

4. Director-General of the Department of Transport, Ministry of Communication, Transport, Post and Construction, as Committee Member, Head of Secretariat, and Standing Member;

5. Director-General of the Treaty and Law Department, Ministry of Foreign Affairs, as Committee Member;

6. Director-General of the Foreign Trade Department, Ministry of Commerce, as Committee Member;

7. Director-General of the Immigration Department, Ministry of Public Security, as Committee Member;

8. Director-General of the Economic Management Department, National Committee of Government Planning, as Committee Member;

9. Director-General of the Customs Department, Ministry of Finance, as Committee Member

10. President of the Lao National Chamber of Commerce and Industry as Committee Member;

11.President of the Insurance Company of Lao PDR as Committee Member;

12. Representative from the Lao Freight Forwarder Association as Committee Member;

13. Representative from the Transportation Association as Committee Member.

5.2. Organizational Structure of the National Transport Committee

The National Transport Committee is a non-stationed organization, but has an office for assisting in work called “Secretariat”, which is the Department of Transport, Ministry of Communication, Transport, Post and Construction as the Secretariat of the National Transport Committee with an abbreviation of “DOT” and consist of a number of staff assisting work as appropriate.

5.3. Secretariat of the National Transport Committee consists of:

The Director-General of the Department of Transport, MCTPC, serves as the Head of Secretariat of the National Transport Committee with some Deputy Heads of Secretariat to assist. Deputy Heads of Secretariat of the National Transport Committee are appointed and removed by the Minister of Communication, Transport, Post and Construction.

 

Chapter IV

Working Method of the National Transport Committee

Article 6. The National Transport Committee operate based on the following Working Method:

6.1.All Committee operation is strictly complied with the policy direction of the Party and Government under the direction of the Ministry of Communication, Transport, Post and Construction;

6.2.To work by follow the united democratic on the basis of consensus principles;

6.3.To work according to plans, deadlines and with consistency;

6.4.To implement reflecting regime and report to the above authorities periodically and regularly;

Article 7.The Minister of Communication, Transport, Post and Construction together with the President of the National Transport Committee are assigned to elaborate details, and set working method for the National Transport Committee and the duties of the National Transport Committee Secretariat as appropriate.

 

Chapter V

Final Provisions

Article 8 – Seal

The National Transport Committee has its own seal to be used in official activities by using the seal of the Ministry of Communication, Transport, Post and Construction, while the Secretariat uses the seal of the Department of Transport.

Article 9 – Implementation

The Ministry of Communication, Transport, Post and Construction in collaboration with line ministries, ministerial-equivalent organizations, and related sectors shall recognize, facilitate, and coordinate with each other in order to effectively implement this Decree.

Article 10 – Effectiveness

This Decree is effective from the date of signature. Requirements, provisions, and regulations that are contrary to this Decree shall be cancelled.
